Service Agreement & Terms of Service (TOS)

1.  This is the purchase of an Investigative Case Assessment and consultation of our highly specialized legal private investigative services CPS case, for us to gain a good understanding of the person’s CPS case and to explain how we help our clients with their cases once hired, and to offer a quote for hiring our firm for ongoing state licensed, highly specialized private investigation for the person’s CPS case.  I also understand it will be performed by a State Licensed Private Investigator, not an attorney and likewise will not be offered nor given any legal advice now or later, if I decide to hire the investigative group after receiving a quote once the Investigative Case Assessment is complete.  I understand that when I type my name as signature and indicate full acceptance, that also applies to all sub-paragraphs to.  I also understand that Seller website(s) namely ReturnMyChild.com also represents these same or similar terms at its website which I understand I can also review before signing and agreeing to this full and entire agreement.  When I submit this form, I will then fully agree to all Terms of Service stated and with no misunderstandings.  BY SUBMITTING THIS FORM, I FULLY UNDERSTAND, ACCEPT, AND AGREE TO ALL SIXTEEN (16) PARAGRAPHS HEREIN, WITH THIS PARAGRAPH, and WITH THE FOLLOWING PARAGRAPHS:

2.  This Service Agreement for legal state licensed private investigative services is executed by filling out this post purchase form by answering the questions and fully agreeing upon the Terms of Service (TOS) as outlined herein this form, and by checking the boxes and typing my name as my signature in the form.

3.  Once the Terms of Service Agreement form has been properly signed and submitted, the investigator will begin reviewing and assessing the information submitted in this form that I voluntarily inform about my case, and will then reasonably attempt to contact me the by phone, within three (3) business days to continue the case assessment by;

3.1.  Discussing the case with the with me to obtain a clear understanding of the issues and problems I am seeking legal private investigative help  with, for the investigator to consider at his/her full discretion and choice, to give me or the interested person to hire, a quote based on this understanding, for hiring the private investigative group for legal investigative services for investigating those issues and/or problems that I the  prospective client and seeking help with, regarding a pre-existing court case.  I understands and agree and understand that the investigator’s only main performance under this full agreement is to perform a brief assessment of the my pre-existing court case, with a consultation of what the investigative services can provide, and to answer questions pertaining thereto, to then afterward, consider offering a quote to me, for me to consider hiring the investigator for legal investigative services for my case.  I also agree that if the investigator)makes at least two (2) attempts to reach me to have the phone call consultation about services, and for the assessment of my case, and I do not respond or do not return phone calls, or send an email/text to let the investigator know of any delays, etc., then I agree that the payment made will be converted to a donation for the cause of helping the investigative group to help more parents needing expert legal investigative help for their CPS cases also.

4.  During the Case Assessment, the phone call discussion between me and the investigator will have no set determined amount of time (i. e. some conversations may last longer than others as appropriate where it may be anywhere from around fifteen (15) to thirty (30) minutes in duration and again, the duration of that call/conversation shall be at the private investigator’s full discretion and choice.  BOTH PARTIES ALSO AGREE TO, CONSENT TO, AND AUTHORIZE ALL VOICE RECORDINGS OF ALL CONVERSATIONS BETWEEN THEM AT ANY AND ALL TIMES OF COMMUNICATIONS WHETHER BEFORE, DURING, OR AFTER THE INVESTIGATIVE CASE ASSESSMENT, AND ALSO IF THE QUOTE OFFERED IS ACCEPTED AND THE INVESTIGATOR IS SUBSEQUENTLY HIRED AFTER THE CASE ASSESSMENT, VOICE/CALL RECORDINGS DURING ANY AND ALL TIMES THROUGHOUT THE ENTIRE INVESTIGATION BEING CONDUCTED.  THIS CLAUSE WILL SERVE AS ONGOING AND PERPETUAL NOTICE TO EACH PARTY.  All conversations are protected by state law to hold an Attorney-Client privilege of confidentiality and privacy.  This means, no matter what our clients state to us in confidence, by state law, we are required to maintain those communication privately and confidentially no matter what the client states, even if the client make an admission of anything whatsoever.  By state law, the investigative firm cannot willfully divulge  a professional secret, and can only communicate with others about his/her client’s case as when reasonable to do so in the performance and conducting of the private investigation, and with taking extra precaution that any communications made about the client or client’s case will not negatively effect the client or the client’s case. Exception to case confidentiality is if the client makes a public statement or complaint about the investigator pertaining to the case, where the investigator would when then need to state the facts of the case against any negative statement, allegation, or complaint made.

5.  I UNDERSTAND AND ACCEPT I MUST BE FULLY SATISFIED WITH THE INVESTIGATOR'S  COMPLETION OF THE INVESTIGATIVE CASE ASSESSMENT AND CONSULTATION BEFORE THE INVESTIGATOR IS WILLING TO OFFER A QUOTE TO ME TO HIRE THE INVESTIGATOR, SINCE IT ISN’T LIKELY THAT THE IF I AM NOT FULLY SATISFIED WITH A CASE ASSESSMENT AND CONSULTATION, THE INVESTIGATOR WOULD NOT BELIEVE I COULD BE SATISFIED ONCE HIRED TO PERFORM ONGOING LEGAL INVESTIGATIVE SERVICES FOR THE ATTEMPT TO HELP ME WITH MY CPS CASE.
 
6.  NO GUARANTEES NOR WARRANTIES WHATSOEVER ABOUT CASE RESULTS WILL BE GIVEN EITHER DURING THE INVESTIGATIVE CASE ASSESSMENT, OR AFTERWARDS IF HIRED TO WORK ON THE CASE IF I ACCEPT THE QUOTE GIVEN AFTER THE ASSESSMENT.  RESULTS WILL ALSO GREATLY VARY FROM CASE TO CASE AND OUR INVESTIGATORS CAN ONLY TRY THEIR BEST TO HELP.  THERE WILL BE NO SIDE OR ADDITIONAL AGREEMENTS MADE ON TOP OF THIS FULL AGREEMENT, UNLESS AGREE TO IN WRITING BY ALL SIGNED BINDING PARTIES OF THIS AGREEMENT, AND ONLY AS MODIFICATION(S) TO THIS ORIGINAL AGREEMENT, IN WRITING.   I ALSO UNDERSTAND THAT CASES DEALING WITH PRE-EXISTING TERMINATION OF PARENTAL RIGHTS WILL OBVIOUSLY BE EVEN THAT MUCH MORE DIFFICULT FOR A PARENT TO BECOME REUNIFIED WITH THEIR CHILD OR CHILDREN REGARDLESS OF HOW GREAT THE INVESTIGATIVE PERFORMANCE IS.

7.  JURISDICTION AND GOVERNING LAWS OF THIS AGREEMENT shall be in the State of Florida.

8.  VENUE of all legal proceedings pertaining to this Agreement shall be located at the Seller's full choice and discretion within the State of Florida.

9.  LIBERTY TO DISCUSS CASE INFORMATION WITH OTHERS AND/OR DISCLOSE CONTENTS OF CASE FILE.  I also agree and accept that the investigative firm is at full liberty to discuss and/or communicate about the case with any associate investigator or anyone whomsoever that may be of any assistance, guidance, or use in any way towards helping me reach my goals and objectives of the case, and/or for appropriate business or training purposes, and if any client should ever have, produce, make, threaten to make, or indicate any complaints or concerns about this agreement outside of our firm, such as addressing them publicly, then our firm shall be entitled to publicly address any and all parts of that complaint or case file, including any and all confidential parts, for the purpose of attempting to clarify anything and/or to assist any third party entity or government agency to mediate and/or rectify any complaints whatsoever.

10.  CONFIDENTIALITY AND NON-DISCLOSURE OF INVESTIGATORS OR AGENCIES.  I also agree to and accept that any and all investigators or firms associated with this transaction shall remain completely confidential and anonymous for the protection of said investigators as this being a case dealing with possible white collar criminals, corruption, racketeering, and for the investigators to remain undercover and unknown to those being investigated, for the safety and protection of said investigators, their associates, and/or affiliates.  Again, Agency/Investigator also reserves the right to legally work this case through and/or in association with any investigative agency of its full choice and discretion while keeping any investigator(s), and/or investigative firm's name(s) as non-disclosed to anyone including the client(s) for the purpose of providing our client with the right to deny knowing the name of any investigator and/or investigative firm that has been responsible for holding members or associates of DSS/CPS accountable for their actions such as if questioned by a CPS attorney under oath in court, or by law enforcement - while also providing safety and security to our investigators from any attacks or vendettas anyone may have as a result of being the subject of our investigation.  In other words, client agrees and accepts that for this fair reason and purpose he/she cannot expect to know the actual or full name of any investigator working the case, investigative firm, or associate firms who or that we may contract with and/or for which any of our investigators or associate investigators may practice under.  The confidentiality of any and all investigators' names shall also be held as fully private, non-disclosed, and confidential as again not expected to be released even to the client – unless court ordered (as in, if we are needed to testify in court to the evidence we produce).

11.  TRADE SECRET, NON-DISCLOSURE, & COPYRIGHT OF ALL FORMS & WORK PRODUCTS.  The buyer also understands and accepts that any and all Agreement Forms, such as this one, and/or Any Others presented to Buyer/Client in the future (such as an actual Retainer and Agreement for Investigative Services), shall be deemed, construed, and used as fully owned and copyright protected by the investigative firm and its investigators.  If investigator is hired after the assessment for highly specialized legal private investigative services pertaining to Buyer’s CPS case, any uncommonly known and/or specialized investigative activities conducted by the investigator, shall be non-disclosed by the client, and treated as a Federally Protected Trade Secret of the investigative agency which is protected under the U.S. Economics Espionage Act of 1996, which became effective on January 1, 1997, which makes it a criminal violation of this Act, for theft and/or misappropriation of trade secrets a federal crime and Conviction of the theft of trade secrets under the Economic Espionage Act can result in a fine of up to $250,000 for an individual and up to $5 million for corporations, imprisonment up to ten years, or both.  Any and all agreement forms, such as this one, and/or any others presented to me the client in the future (such as an actual Retainer and Agreement for Legal Investigative Services), shall also be deemed, construed, and used under a strict NON-DISCLOSURE AGREEMENT which means I the client of this Assessment and/or future client, agree NOT TO DISCLOSE the content of this Agreement or any other Agreements offered to me by this Seller/Investigator/Firm, TO ANYONE ELSE WHOMSOEVER THAT IS NOT A SIGNED CLIENT OF THE INVESTIGATOR.

12.  AFTER THE INVESTIGATIVE CASE ASSESSMENT, WHAT TO EXPECT IF PROSPECT ACCEPTS THE QUOTE FOR HIRING TO INVESTIGATE, ONCE WE ARE FULLY HIRED.  Our prospect will receive a written Agreement for Investigative Services which will outline many things that our investigators may find interest in investigating however, the main first sets of paragraphs of that Service Agreement which outline our services are the same or very similar to:

12.1 Parental Rights Defense & DSS/CPS Fraud, Negligence, Corruption, Racketeering and Civil Rights Violations Investigation.  This investigation includes but is not limited to;

12.2.  Our best efforts in attempt at securing evidence and of its preparation for the defense of a DSS/CPS case against client(s), helping the client(s) to become much more organized in their case, namely, for our efforts in the securing and preparation of probative evidence, helping our client(s) to accomplish productive case oriented goals and tasks for our efforts in the securing and preparation of probative evidence, and for our team to reasonably address and examine all possible forms of evidence, and for our team to reasonably address problems and issues all throughout the case, and for our team to have reasonable ongoing investigative case consulting/communications with the client(s), and in a team-oriented fashion, towards case productivity in our best efforts in attempting to help our client(s) reach all reasonable goals, as the investigative group finds appropriate.

12.3.  Our best efforts in attempt at legally investigating and legally holding those responsible for violating the parental rights of our client(s) and/or of any other laws/rights whatsoever, accountable for their actions, as the investigative group finds appropriate.  
 
12.4.  Our best efforts in attempt at securing evidence and of its preparation for the defense of any criminal charges against our client(s), as the investigative group finds appropriate.
 
12.5.  Our best efforts in attempt at securing evidence and its preparation for any possible civil lawsuit(s) executed by client(s), having reference to any of the aforementioned matters being investigated.  In the event after our hiring, that our client wins or settles a civil lawsuit/demand against any department of social services and/or associated or affiliated party, client agrees to also allow this to serve as a contingency agreement for our investigative firm to receive twenty-five percent (25%) of any gross amounts awarded by the court and/or from any settlements as additional compensation for services.

13.  BACKGROUND OF PRACTITIONER, DUE DILIGENCE, & LIABILITY FOR DEFAMATION.  I the Buyer(s) have read and/or watched videos of many positive client testimonies of the investigative group, and read the Background and Due Diligence information at the Seller’s website, and understand, acknowledge and accept due to the fact that the fully licensed investigative agency is indeed the leading firm in the nation since 2009 with helping very many families nationwide, the investigator has been reached by thousands of individuals over the years and has later found out sometimes after being hired, that some client(s) are not fit to be parents and seem to only want to blame others including the investigators for not being able to get their child or children back.  Some even go so far to act like haters, make threats, and even make false smears online who are proven convicted sexual predators, pedophiles, sexual child molesters, and child abusers, and some with severe documented mental illnesses.  The investigative group does however provide full investigative defense for those whom have been wrongly accused of those acts/crimes.  Nonetheless, some of these types of people support the coining of the phrase "misery loves company" - by trying to attack our firm's well-proven track record of the highest client satisfaction and case success, by attempting to mislead actual good parents who need true help with their CPS cases.  This paragraph is here to make clear that our investigators are not loved by and cannot help everyone out there, and to reiterate that we can only try our best efforts to help our clients with no guarantees nor warrantees of case results given.  I the client and possible future client of ongoing legal investigative activities also acknowledge the fact that private investigation for CPS cases is not very common and is a highly specialized area of private investigative practice, of which I accept and appreciate that my Private Investigator uses dynamic, novel, not commonly known, and highly specialized legal investigative methods  and activities at his/her full discretion and choice if I hire the investigator(s) to work on my CPS case.

14.  LIABILITY FOR DEFAMATION.  I also acknowledge and accept that I have spent a reasonable amount of time reading reviews and testimonies about this investigative group - to where there is no misunderstanding that this investigative group indeed has enough and even an overwhelming amount of legitimate and verifiable positive testimonies at their website and/or at other websites to merit there to be no good reason for me the Buyer to later claim negative things about any investigator of this group, especially if there are any negative statements made about any of the investigators in this group that have not been proven in a court of law.  I the client also agree to and accept to be fully liable for all court costs, attorney's fees, and post collection expenses if I commit any acts of defamation against the investigator.  I the client accept a minimum liability of twenty-five $25,000.00 USD for any breaches whatsoever of this paragraph and of its sub/adjoining parts, found and/or ordered by any court of law.

15.  SEVERABILITY.  If any part of this agreement may be deemed as unjust or unfair by any court of law, then parties agree those parts shall be severed and the remaining parts shall remain in full force and effect.

16.  FULL AND ENTIRE AGREEMENT.  This shall constitute the full and entire agreement which shall supersede any prior express, or written agreements, and/or interpretations of this agreement (including anything represented online or offline).
